If you’ve been injured through no fault of your own, the idea of making a claim can feel daunting — especially when you’re also dealing with recovery, time off work, and the stress that follows an accident. The good news is that the process in Ireland is more structured, and more predictable, than most people expect.
This guide walks through what actually happens from the moment you decide to make a claim, so you know what’s coming at each stage and where a solicitor fits in.
Oak Legal acts exclusively for injured parties — never for insurance companies or defendants.
Do you have a claim?
Broadly, you may be entitled to compensation if someone else’s negligence caused you harm. In practice that covers a wide range of situations — and it isn’t always obvious at first whether a claim exists. The most common categories we act on are set out below.
The process, step by step
Most personal injury claims in Ireland follow the same broad path. Timings vary with the complexity of the case and the extent of your injuries, but the sequence is consistent.
We assess whether you have a claim, explain your options, and set out likely costs. This first meeting is free and entirely without obligation.
We obtain a medical report on your injuries and collect the evidence needed — records, photographs, witness details, and receipts for any losses.
Most claims must first go to the Injuries Resolution Board, which assesses your injury and proposes an award without the need for court proceedings.
If the assessment is accepted by both sides, your claim settles. If not, we advise on issuing proceedings — though most cases resolve without a hearing.
Mind the deadlines
This is the point clients most often get caught out on. Personal injury claims carry strict time limits, and missing one can end an otherwise strong case before it begins.
The standard limitation period for personal injury is two years, though it can run from the date you became aware of the injury rather than the accident itself. Exceptions apply — so if you think you may have a claim, it is always best to speak to a solicitor early.
